Terms of Service

These Terms of Service ("Terms") set forth the conditions for using the Discord Bot "Monvoke" and all related services including this website (https://monvoke.xyz) and the support Discord server (collectively, "the Service"), as established by the operator of the Service ("the Operator").

Article 1 (Scope)

These Terms apply to all relationships between users of the Service ("Users") and the Operator regarding the use of the Service.

The Operator may establish additional rules, guidelines, or other individual provisions ("Individual Provisions") regarding the Service.

Individual Provisions, regardless of their title, constitute part of these Terms.

In the event of a conflict between these Terms and Individual Provisions, the Individual Provisions shall prevail unless otherwise specified.

In the event of a conflict between these Terms and Discord's Terms of Service, guidelines, or other regulations, Discord's regulations shall prevail.

Article 2 (Use of the Service)

The Service is a bot service for Discord servers.
By using the Service, Users are deemed to have agreed to all contents of these Terms.

Article 3 (Prohibited Activities)

Users shall not engage in the following activities:

• Activities that violate laws or public order and morals
• Activities that violate Discord's guidelines or Terms of Service
• Activities that cause disadvantage, damage, or discomfort to other Users or third parties
• Activities that interfere with the operation of the Service
• Large-scale commercial use without the Operator's permission
• Other activities deemed inappropriate by the Operator

Article 4 (Usage Restrictions)

The Operator may restrict all or part of the Service without prior notice if a User is found to fall under any of the following:

• Violation of Discord's guidelines or Terms of Service
• Violation of any provision of these Terms
• Failure to fulfill payment obligations
• Other cases where the Operator deems the use of the Service inappropriate

The Operator shall not be liable for any damages incurred by Users as a result of actions taken under this Article.

Article 5 (Cancellation of Paid Plans)

Users with an active paid plan may cancel at any time.

• To cancel, go to the "Subscription" section of your dashboard and follow the cancellation process.
• After cancellation, the Service remains available until the end of the current billing period.
• Refunds after cancellation will not be issued except as required by applicable law.
• Kicking or banning the Bot from your Discord server does not automatically cancel your subscription. Please cancel through the dashboard.

Article 6 (Service Suspension)

The Operator may suspend or interrupt all or part of the Service without prior notice to Users if any of the following reasons are found:

• Maintenance or updates to the Service systems
• Force majeure events such as earthquakes, lightning, fire, power outages, or natural disasters
• Failures in communication lines or computer systems
• Other cases where the Operator deems service provision difficult

The Operator shall not be liable for any damages incurred by Users or third parties due to suspension or interruption of the Service.

The Operator may also change the content of the Service or discontinue its provision without notice to Users.

Article 7 (Changes to the Service)

The Operator may change all or part of the Service content without prior notice to Users for operational reasons.

This includes the addition, modification, restriction, or removal of features included in the Service.

The Operator shall not be liable for any damages incurred by Users as a result of such changes.

Article 8 (Disclaimer of Warranty and Limitation of Liability)

The Operator makes no express or implied warranties regarding the absence of defects (including safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, and security) in the Service.

The Operator shall not be liable for any damages incurred by Users arising from the Service.
However, this disclaimer does not apply if these Terms constitute a consumer contract under the Consumer Contract Act.

Even in the case of the preceding proviso, the Operator's liability for damages caused by negligence (excluding gross negligence) shall be limited to direct and ordinary damages incurred by the User, up to the amount of usage fees received from the User in the month when the damage occurred.

The Operator shall not be liable for any transactions, communications, or disputes between Users or between Users and third parties in connection with the Service.

Article 9 (Changes to Terms)

The Operator may change these Terms without notice to Users when deemed necessary.
The revised Terms shall take effect from the time they are displayed on the Service.

Article 10 (Handling of Personal Information)

The Operator shall handle personal information obtained through the use of the Service appropriately in accordance with a separately established Privacy Policy.

Article 11 (Governing Law and Jurisdiction)

These Terms shall be governed by and construed in accordance with the laws of Japan.

Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the Matsuyama District Court or the Matsuyama Summary Court as the court of first instance.
